South Africa: Constitutional Court orders reopening of access for asylum seekers

South Africa has restored access to the asylum application process for anyone wishing to apply, including those who entered the country irregularly or without a visa, in accordance with a Constitutional Court ruling issued on July 7, 2026. The decision removes several administrative barriers deemed unconstitutional and guarantees that applications will be considered, without legalizing irregular entry or guaranteeing refugee status.
